Thank you for visiting Learning Trade Center of Florida (LTCF). These Terms of Service (the “Terms”) govern the use of the website https://learningtcf.com (the “Site”) and all educational and digital services offered (the “Services”). By registering, purchasing, subscribing to, or using the Site and Services, you (“User”) represent that you have read and expressly agreed to these Terms and our Privacy Policy.

⚠️ This agreement includes an individual arbitration clause and class action waiver.

1. User Accounts

1.1 Requirements

  • Be at least 18 years of age.
  • Not be previously suspended or terminated by LTCF.

1.2 Registration and Security

The User must provide truthful and up-to-date information. The User is responsible for maintaining the confidentiality of their credentials and for all activity conducted under their account. LTCF may apply additional security measures such as two-step verification.

2. Privacy

The processing of personal data is governed by our Privacy Policy, published on the Site.

3. Modifications

LTCF may update these Terms at any time. The new version will be published on the Site and, where applicable, users will be notified by email. Continued use of the Site constitutes acceptance of the updated Terms.

4. Payments, Subscriptions, and Refunds

4.1 Pricing

All prices are displayed in USD and include applicable U.S. taxes. International users are responsible for any taxes, duties, or fees applicable in their respective countries.

4.2 Payment Methods and Explicit Consent

Upon completing a purchase or subscription, the User is required to actively check a confirmation checkbox during the checkout process. By checking this box, the User expressly acknowledges and agrees that:

  • The purchase may include automatic recurring charges.
  • The User authorizes such charges until the subscription is canceled.
  • The User is solely responsible for canceling the subscription, either through the website or by contacting customer support directly.
  • The User has read and accepts these Terms and Conditions.

The User understands that charges will continue unless and until the subscription is properly canceled. Failure to cancel does not constitute a billing error or unauthorized charge. This action constitutes a legally binding acceptance of these Terms.

4.3 Monthly Subscription

USD $59.99 per month, with automatic renewal unless canceled prior to the renewal date.

4.4 Non-Payment

Access may be suspended until payment is brought current.

4.5 Refunds

  • Refunds are available only within 7 days of the first subscription payment.
  • Refunds do not apply to automatic renewals or partial billing periods.

4.6 Certification Conditions

Any certificate, completion record, or academic recognition issued by LTCF is contingent upon full, valid, and unreversed payment of all fees associated with the course or service. LTCF reserves the right to suspend, revoke, or invalidate any certification in the event of non-payment or transaction irregularities.

4.7 Disputes, Chargebacks, and Reversals

In the event that the User initiates a dispute, chargeback, reversal, or claim through their bank, financial institution, or payment processor, LTCF reserves the right to:

  • Suspend or cancel the User’s account.
  • Revoke or invalidate any issued certifications.
  • Restrict access to courses, materials, or services.
  • Flag the account for internal administrative review.

The User acknowledges that initiating a dispute is not a valid method of canceling the service. Any certification associated with disputed or reversed payments may be considered invalid or suspended until the payment matter is resolved.

4.8 Identity Verification and Fraud Prevention

LTCF reserves the right to request additional information to verify the identity of the User and the legitimacy of the payment method, including but not limited to:

  • Cardholder’s name.
  • Billing address.
  • Government-issued ID.
  • Confirmation of authorization from the payment method holder.

LTCF may temporarily suspend access to services until the verification process is satisfactorily completed. In the event of inconsistencies, suspected fraud, or unauthorized use of payment methods, LTCF may cancel the account, revoke certifications, and reject future transactions.

4.9 Third-Party Payers and Payment Authorization

When a transaction is made by a person other than the end user of the service (e.g., a family member, spouse, employer, or other third party), the payment method holder expressly declares that:

  • They are legally authorized to complete the transaction.
  • They have obtained the end user’s consent to purchase the service on their behalf.
  • They accept these Terms and Conditions in full, both on their own behalf and on behalf of the designated user.

LTCF shall not be held responsible for disputes, conflicts, or claims arising between the payer and the end user. Any dispute initiated under the claim of “unauthorized charge” will be contested with evidence of the completed purchase process, including the checkbox confirmation, IP address, device, and transaction timestamp. Access to the course is tied to the account registered at the time of purchase, regardless of who made the payment.

4.10 One-Time Purchases and Payment Modalities

In addition to the monthly subscription model, LTCF may offer courses under the following payment modalities:

  • One-time payment: The User pays a single amount and receives access to the course for the period indicated at the time of purchase (limited or indefinite, depending on the program).
  • Installment plan: The User pays the total course price in installments according to the selected plan. Access remains active while payments are current. Failure to make any installment payment may result in access suspension until the outstanding balance is settled.
  • Monthly subscription: USD $59.99/month with automatic renewal as set forth in §4.3.

In all cases, the refund policy in §4.5 applies only within the first 7 days of the initial payment. Subsequent installments and renewal payments are non-refundable. LTCF reserves the right to modify available payment modalities by program without affecting already confirmed purchases.

5. Authorized Use

The User receives a personal, non-exclusive, and non-transferable license to access the purchased content. Reproduction, redistribution, sublicensing, or use of materials for commercial purposes or for teaching third parties is prohibited.

5.1 Use Restrictions and Content Protection

The User agrees that access to the courses is strictly personal and individual. The following are expressly prohibited:

  • Sharing login credentials with third parties.
  • Allowing simultaneous access from multiple unauthorized locations or devices.
  • Recording, copying, downloading, reproducing, or distributing content by any means.
  • Sharing materials through platforms such as WhatsApp, Telegram, social media, or other channels.
  • Using content to create derivative courses or for commercial purposes.

LTCF reserves the right to implement technical measures to detect unauthorized access, including but not limited to IP monitoring, device tracking, and usage pattern analysis. In the event of detected misuse, LTCF may suspend or cancel access without prior notice and without entitlement to a refund.

6. User Content

Any review, comment, or suggestion submitted may be used by LTCF for improvement, communication, and promotional purposes, under a non-exclusive, worldwide, royalty-free license.

7. Intellectual Property

All content available on the platform, including but not limited to courses, educational materials, videos, texts, scripts, assessments, academic structure, platform design, logos, trademarks, certificates, and documents, is the exclusive property of Learning Trade Center of Florida LLC or its licensors.

Such content is protected by United States copyright law (U.S. Copyright Act) and applicable international treaties. The User does not acquire any ownership rights over the content — only a limited license to use it in accordance with these Terms. Any unauthorized use may result in civil and/or criminal legal action.

8. Disclaimers and Limitations

  • Services are provided “as is” and “as available.”
  • Approval of external certifications (e.g., EPA 608) depends exclusively on meeting requirements established by third parties.
  • Certificates issued by LTCF do not replace official state or federal licenses.
  • LTCF does not guarantee that the student will pass the EPA 608 exam or any other external certification exam. The preparation offered is educational in nature. Results depend exclusively on the individual student’s performance and the criteria of the external evaluating body. The registration fee is non-refundable under any circumstances (see §13.2).

9. Limitation of Liability

LTCF’s maximum liability is limited to the greater of:

  • USD $100, or
  • The amount paid by the User in the past 12 months.

LTCF shall not be liable for indirect, incidental, consequential damages, loss of revenue, or loss of opportunity.

10. Dispute Resolution

  • Individual and binding arbitration administered by JAMS or AAA, in Florida or virtually.
  • Express waiver of jury trial and class action lawsuits.
  • The User may opt out by notifying support@learningtcf.com within 30 days of acceptance.

11. Termination

LTCF may suspend or cancel accounts for violations of these Terms. The User may cancel at any time; the refund rules in Section 4.5 apply. Termination by LTCF due to a breach of these Terms will not entitle the User to a refund.

12. General Provisions

  • Governing law: State of Florida, U.S.A.
  • Severability: the invalidity of one clause does not affect the remainder.
  • Assignment: the User may not transfer rights without authorization; LTCF may do so.
  • Entire agreement: these Terms supersede any prior agreements.
  • Governing language: These Terms may be available in both Spanish and English. In the event of any discrepancy or conflict between language versions, the English version shall prevail and is considered the original and legally controlling version.
  • Force majeure: LTCF shall not be liable for interruptions, delays, or failures in the provision of Services caused by circumstances beyond its reasonable control, including but not limited to third-party infrastructure failures, cyberattacks, natural disasters, pandemics, government actions, or internet service outages. In such cases, LTCF will make reasonable efforts to restore service and may, at its discretion, grant access extensions or credit to affected students.

13. Certification, Licensing, and External Exam Fees

13.1 LTCF Certifications

  • Digital completion certificate: included at no additional cost.
  • Printed certificate: USD $49.99 (includes processing and shipping).

Printed certifications are issued only after full payment and eligibility verification. Delivery is made via postal mail or courier to the address provided by the student. Processing may take up to fifteen (15) business days. LTCF is not responsible for errors in the address provided by the User or for delays attributable to external courier services.

13.2 EPA 608 Exam Registration (Independent Third Party)

  • LTCF processing and coordination fee: USD $59.99.

The EPA 608 exam is administered exclusively by an independent evaluation organization (e.g., Prometric or another authorized provider). LTCF acts solely as a facilitator of the registration process and does NOT administer the exam, does NOT issue the EPA 608 license, and does NOT guarantee exam passage.

⚠️ The USD $59.99 registration fee is NON-REFUNDABLE under any circumstances, including cases where the student does not pass the exam, does not appear on the scheduled date, or decides not to take the exam once the registration process has begun.

Exam rescheduling is subject to the external provider’s policies and may incur additional charges that are the exclusive responsibility of the student.

14. Cancellation and Guarantee Policies

  • Cancellation: at any time via account settings or support.
  • Refunds: only within 7 days of the first payment.
  • Academic guarantee: access while the subscription is active.
  • Technical support: in the event of platform failures, LTCF may grant an extension or credit.

15. Price Modifications and Promotions

LTCF reserves the right to modify prices, discounts, and promotions at any time. Changes will not affect already confirmed purchases. Promotions may be subject to conditions and limited-time availability.

16. System Errors and Incorrect Enrollments

LTCF is not responsible for technical errors, integration failures, duplications, or incorrect pricing. LTCF may correct the User’s account to reflect the correct purchase without generating additional rights.

17. Live Exam Scheduling

Live exams are scheduled in order of course completion and subject to availability. Wait times may range from 1 to 4 weeks. Rescheduling does not entitle the User to financial compensation or additional benefits.

18. Scope of Educational Services and Legal Disclosures

Learning Trade Center of Florida LLC is a private educational training institution offering unregulated technical and educational programs. These programs do not constitute professional licenses, state certifications, official academic degrees, or authorization to practice in any jurisdiction.

Programs offered include, but are not limited to:

  • HVAC (Heating, Ventilation, and Air Conditioning)
  • EPA 608 Exam Preparation
  • A2L Refrigerants and Flammable Refrigerant Handling
  • Professional Manicure and Acrylic Nails
  • High-Demand Commercial Baking
  • Residential Electrical Distribution
  • TrueESL (English as a Second Language)
  • Professional Makeup

LTCF reserves the right to add new programs or modify existing ones without prior notice.

Certificates issued by LTCF reflect only course completion and do not substitute for state or federal licenses. It is the student’s sole responsibility to verify applicable requirements in their jurisdiction.

When a student chooses to take an external certification exam (including EPA 608), that exam is administered by an independent evaluation organization. LTCF does not administer exams, does not act as an evaluation center, and does not issue official licenses.

18.1 Specific Notice — Manicure and Acrylic Nail Programs

The Professional Manicure and Acrylic Nails course offered by LTCF is a private educational program of a technical and training nature. This course does NOT replace, equal, or satisfy the training hour requirements established by the Florida Board of Cosmetology (or equivalent agencies in other states) for obtaining a Nail Specialist, Cosmetologist, or any other regulated professional license.

The professional practice of manicure services, acrylic nails, or other cosmetic treatments may require a state license. It is the student’s sole responsibility to verify and comply with the applicable legal and regulatory requirements in their state or locality before practicing professionally.

18.2 Specific Notice — Residential Electrical Distribution Program

⚠️ IMPORTANT LEGAL NOTICE — PLEASE READ CAREFULLY

The Residential Electrical Distribution course offered by LTCF is a private educational program of a technical and training nature. The sole purpose of this course is to provide general educational knowledge about residential electrical systems.

This course does NOT replace, equal, satisfy, or qualify the student to:

  • Obtain an Electrical Contractor, Electrician, or any other electrical license regulated by the Florida Department of Business and Professional Regulation (DBPR) or equivalent agencies in other states.
  • Perform electrical work for commercial or residential purposes in any jurisdiction without the required state license.
  • Conduct electrical installations that require municipal or state permits.

In the State of Florida, performing electrical work without the required license constitutes a violation of state law and may result in civil and/or criminal penalties. It is the student’s sole responsibility to verify and comply with all applicable legal, regulatory, and licensing requirements in their state or locality before performing any electrical work.

⚠️ LTCF assumes no liability for damages, injuries, accidents, legal penalties, or any consequences arising from the practical application of knowledge acquired in this course without the proper license and authorization.

19. Results, Employment, and Income

LTCF does not guarantee employment, income, official licenses, or specific outcomes. Results depend on individual effort, prior experience, local regulations, and market conditions.

20. Testimonials and Experiences

Testimonials reflect individual experiences and do not guarantee similar results for all users. They should not be interpreted as promises of employment, income, or certification.

21. Accessibility

LTCF is committed to providing reasonable accessibility to its content. Users may request accommodations by writing to support@learningtcf.com.

22. Copyright and DMCA

LTCF respects intellectual property rights. Any copyright claim may be submitted in accordance with the Digital Millennium Copyright Act (17 U.S.C. §512). LTCF reserves the right to remove content that infringes the law.

23. Unauthorized Commercial Use

The use of LTCF content for commercial purposes, including teaching third parties, creating academies, courses, or derivative programs, is strictly prohibited without express written authorization from LTCF.
